Understanding Notarization Types

What Is an Acknowledgment?

An acknowledgment is a notarial act where the signer confirms to the notary that they signed the document voluntarily and that their identity has been verified. The signer does not need to sign in front of the notary, but must personally appear and acknowledge the signature as their own. This is the most common type of notarization, used for deeds, powers of attorney, and many legal documents.

What Is a Jurat?

A jurat is a notarial act where the signer must sign the document in front of the notary and swear or affirm that the contents of the document are true. Unlike an acknowledgment, a jurat requires both the signing and an oath to happen in the notary's presence. Jurats are commonly used for affidavits, sworn statements, and court documents.

When Do You Need a Notary vs. a Lawyer?

A notary public verifies the identity of signers and witnesses signatures on documents. A notary does not provide legal advice, draft legal documents, or explain the legal effects of a document. If you already have your documents prepared and just need them signed and notarized, a notary is all you need.

If you need help understanding what a document means, need a document drafted, or have questions about your legal rights, consult a licensed attorney. Many people use both: a lawyer prepares the documents and a notary handles the signing.

How to Prepare for a Notary Appointment

  1. Bring a valid, government-issued photo ID such as a driver's license or passport. The ID must be current and not expired.
  2. Do not sign your documents ahead of time. Massachusetts law requires the notary to witness your signature in person. If you have already signed, contact the notary before your appointment.
  3. All signers must be present. Every person whose signature needs to be notarized must appear in person at the appointment.
  4. Bring any required witnesses. Massachusetts requires two witnesses for wills and healthcare proxies. The notary does not provide witnesses.
  5. Know what type of notarization you need. Check your document for instructions that say "acknowledgment" or "jurat." If you are unsure, ask before your appointment.
